Fuel manufacturer threatens to sue EPA over renewable fuel standard

A major fuel manufacturer is threatening to sue the Environmental Protection Agency for failing to issue the final 2014 renewable fuel standard (RFS).

The American Fuel and Petrochemical Manufacturers (AFPM) filed a notice of intent to sue the agency for not releasing a final rule, which tells refiners how much ethanol and biofuel they must blend into the nation’s fuel supply, by Nov. 30, 2013.

{mosads}The notice comes amid reports that the EPA may be pulling its rule from the White House Office of Management and Budget on Friday, after the office reached its 90-day review deadline on the 2014 standards.

“EPA’s failure to comply with RFS deadlines has caused additional harm to obligated parties, including AFPM members. We urge EPA to take prompt action to promulgate the 2014 standards,” said AFPM President Charles T. Drevna.

“The fact that EPA proposed the 2014 standards over a year ago, and now 2014 is almost over, is another reason why Congress needs to step in and repeal or significantly reform this badly broken program,” Drevna added.
