NJ considering expanding infertility coverage to lesbians

State lawmakers in New Jersey are proposing legislation that would expand infertility coverage to include lesbians, women without partners and those who have protected sex, The Associated Press reports.

{mosads}The state’s current law requires insurance companies cover expenses considered medically necessary as part of infertility treatment.

But it defines infertility as failure to conceive after two years of unprotected sex for women younger than 35 or after one year for women older than 35. 

Erin Krupa was denied insurance coverage because she couldn’t show she couldn’t get pregnant by having sex with a man. 

Now she’s suing her insurance company after paying $25,000 in out-of-pocket medical expenses for infertility treatments. 

Currently only two states, Maryland and California, have laws that require insurance companies cover infertility treatments for same-sex couples.
