McCaul: Clinton could be impeached if she wins
House Homeland Security Chairman Michael McCaul (R-Texas) on Wednesday said he thinks Hillary Clinton could be impeached over her private email server if she reaches the White House.
{mosads}McCaul, who has been mentioned as a possible 2018 primary challenger to Sen. Ted Cruz (R-Texas), said during an interview on Fox News that the FBI investigation into Clinton’s use of a private server while secretary of State will continue whether the Democratic nominee becomes president or not.
“But assuming she wins, and the investigation goes forward and it looks like an indictment is pending, at that point in time under the Constitution, the House of Representatives would engage in an impeachment trial,” he said on Fox News.
“It would go to the Senate and impeachment proceedings and removal would take place.”
McCaul said the investigation into Clinton’s private server is a “unique case.”
“I would hate to see this country be thrown into a constitutional crisis because of Hillary Clinton’s behavior,” he said.
Last week, FBI Director James Comey sent a letter to lawmakers telling them the bureau would be reviewing newly discovered emails “pertinent” to its investigation into Clinton’s private sever.
Since the release of the letter, Democrats and Clinton aides have been ramping up pressure on the FBI to release more details about the new review.
“With the new emails, if there is classified information, particularly emails that could have intent in those emails. We saw Podesta’s WikiLeaks emails saying to dump all these emails, that’s getting a little closer to intent,” McCaul said, referring to Clinton campaign chairman John Podesta.
“If we see an email that says ‘I know that’s classified but send it anyway,’ that would be the kind of smoking gun the FBI is looking for.”
McCaul said that would be ground for an indictment.
He added he thinks the case should have gone before a grand jury to remove the politics from it.
“I think there’s ample evidence with a probable cause to get the search warrant now to go before the grand jury and present this new evidence,” he said.
