High Court Rejects Challenge to Obama’s Eligibility
The Supreme Court has turned down an opportunity to hear a case challenging whether President-elect Barack Obama is eligible to assume the presidency because of his birthplace.
The court rejected hearing Donofrio v. Wells, a case brought by a New Jersey resident against the Secretary of State, seeking to prevent the election official from certifying the state’s electoral votes in favor of Obama.
“The application for stay addressed to Justice Thomas and referred to the Court is denied,” the court wrote in a small statement accompanying the decision to reject the case.
Though the court was not expected to take the case, the decision removes one technical headache for the incoming administration.
