Dems propose new right for workers to request flexible work conditions

“It’s time for employers and the government to recognize the 21st century needs of families — to help raise kids or care for aging parents — more effectively,” said Rep. Carolyn Maloney (D-NY), the lead sponsor of the House bill.

{mosads}Sen. Bob Casey Jr. (D-Pa.), the lead Senate sponsor, said the bill is needed because the struggling economy makes it harder for people to balance work and home life.

“This bill will help businesses benefit from more productive employees and empower workers with the knowledge of what arrangements are possible to accommodate their family life,” he said.

Under the bill, employees would have the legal right to request a more flexible work schedule. Employers would be required take certain steps in response, such as hold a meeting with the employee and provide a written decision. These written answers must describe why the employer may decide against the request.

If a request were rejected, the employee would have a legal right to suggest an alternative employment situation.

The bill also makes it illegal for employers to interfere or try to deny workers these rights, or discriminate against employees who make alternative employment requests. It also contains detailed enforcement provisions, including language that lets employees file complaints to the Department of Labor, which could lead to an investigation.

Employees could also file petitions in federal court against companies that fail to follow the law.
