Legal pundit and analyst Jeffrey Toobin took a shot at Supreme Court Justice Clarence Thomas for his views on the Jan. 6, 2021, attack on the U.S. Capitol, calling the justice a “disgrace.”
“In oral argument today, Justice Thomas is minimizing the severity of the 1/6 insurrection at the Capitol,” Toobin wrote Tuesday on the social platform X. “Perhaps that’s because his wife was part of the conspiracy. What a disgrace that he’s sitting on this case.”
The Supreme Court’s conservative justices during Tuesday’s arguments signaled wariness of the Justice Department’s far-reaching prosecution of the Capitol attack. Thomas specifically implied a charge the government is using against a former police officer accused of storming the Capitol on Jan. 6 hasn’t been used for other violent protests.
Ginni Thomas, the justice’s wife, reportedly exchanged emails with John Eastman, the lawyer who drafted memos for the Trump campaign laying out how to keep the former president in office.
Toobin, a leading legal affairs journalist, was most recently an analyst for CNN. He left in 2022 after being placed on leave a year earlier following an episode in which he exposed himself during a Zoom call to colleagues at The New Yorker, which fired him.
Toobin’s post on X was roundly mocked by conservatives.
