Mangione lawyers ask judge to dismiss state murder charges

The attorneys for Luigi Mangione, the man accused of murdering UnitedHealthcare CEO Brian Thompson, filed a Thursday motion seeking to dismiss state charges against him. 

Lead lawyer, Karen Friedman Agnifilo, argued that dueling federal charges would amount to double jeopardy for her client. 

If the charges aren’t dropped, Friedman Agnifilo has asked a judge to throw out evidence linking Mangione to the crime scene. The defendant was found in possession of a handgun, ammunition and a notebook detailing plans to “wack” Thompson, according to The Associated Press. 

Agnifilo says police arrested Mangione without Mirandizing him and searched him without a warrant.

“Yet, despite the gravest of consequences for Mr. Mangione, law enforcement has methodically and purposefully trampled his constitutional rights,” Mangione’s team of lawyers wrote in the 57-page filing as reported by the AP.

He’s pleaded not guilty to the state and federal charges and will await his next court date in a Brooklyn jail. 

No trial date has been set in either case.
