A House Democrat says Jared Kushner may have committed an “indictable” offense and should have his security clearance revoked.
Kushner, President Trump’s son-in-law and senior adviser, has said leaving meetings with foreign officials off of his security clearance form was an accident.
But Rep. Don Beyer (D-Va.) and other Democrats aren’t willing to let him off the hook.
{mosads}“Having omitted really significant pieces of information, which I’m not a prosecutor but, a quick reading of the law suggests that … a security clearance could be denied just on this alone and might even be [an] indictable offense,” Beyer told The Hill.
However, an attorney specializing in security clearance matters says that’s not likely to happen in this case.
“I honestly don’t think that unless the FBI wanted to make issue out of it that it would be something he would be indicted [for],” said John V. Berry of Berry & Berry, PLLC.
Berry said if Kushner were a “regular person” and made the same omissions, “it’s very likely” he would have been “charged with lack of candor for non-disclosures, in which case … you ultimately fail to get the clearance, and it would stop the processing, especially if we’re dealing with high-level foreign officials.”
